Copyright & DMCA Policy

AAA Designs LLC ("AAA Designs," "we," "us," or "our"), the operator of APEX (the "Service"), respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 ("DMCA"), 17 U.S.C. § 512, we will respond promptly to clear notices of alleged copyright infringement that comply with this policy. This policy also describes the process for counter-notification and our policy for terminating repeat infringers.

1. Designated Copyright Agent

2. Filing a notice of alleged infringement

If you believe that material available on or through the Service infringes a copyright you own or control, you may submit a written notification to our Designated Agent. To be effective under 17 U.S.C. § 512(c)(3), your notice must include all of the following:

Upon receipt of a valid notice, we will remove or disable access to the allegedly infringing material within a reasonable time and will make a good-faith effort to notify the affected user.

3. Counter-notification

If you believe your material was removed or disabled by mistake or misidentification, you may submit a written counter-notification to our Designated Agent. To be effective under 17 U.S.C. § 512(g)(3), your counter-notification must include:

If we receive a valid counter-notification, we may restore the removed material in 10 to 14 business days unless the original complaining party notifies us that they have filed a court action seeking to restrain the allegedly infringing activity.

4. Repeat-infringer policy

In accordance with 17 U.S.C. § 512(i), we will, in appropriate circumstances, suspend or terminate the accounts of users who are determined to be repeat infringers. We reserve the right to suspend or terminate any account, remove content, and take other appropriate action at our discretion for any actual or suspected infringement, whether or not it constitutes repeat infringement.

5. Misrepresentations

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake or misidentification, may be liable for damages, including costs and attorneys' fees. Do not make false claims.

6. Relationship to the Terms

This policy is part of, and incorporated into, our Terms of Service. Capitalized terms not defined here have the meaning given in the Terms. We may update this policy from time to time; the "Last updated" date reflects the most recent version.
